1. Acceptance of terms

By accessing or using the Voxpect AI website or platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, customers, and anyone else who accesses the Service.

2. Description of service

Voxpect AI provides an AI-powered voice outbound platform that automates prospect qualification and lead scoring for B2B sales teams. The Service is custom-built and configured for each customer and is provided on a business-to-business basis.

3. Eligibility

You must be at least 18 years of age and represent a business entity to use the Service. By using the Service, you represent and warrant that you meet these requirements.

4. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation, including telemarketing and do-not-call laws.
  • Contact individuals without a lawful basis or required consent under applicable law.
  • Harass, abuse, or harm any person.
  • Transmit spam, unsolicited communications, or deceptive content.
  • Reverse-engineer, copy, or resell any part of the Service.
  • Interfere with the operation or security of the Service.

You are solely responsible for ensuring your use of the Service complies with all applicable telemarketing, privacy, and communications laws in your jurisdiction.

5. Customer data

You retain ownership of all prospect data and call data you provide or generate through the Service. By using the Service, you grant us a limited licence to process that data solely to deliver the Service to you. We do not use your customer data to train models or for any purpose beyond providing and improving the Service for your account.

6. Intellectual property

The Service, including all software, designs, and content, is owned by Voxpect AI and protected by intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

7. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or achieve any particular sales outcome. AI-generated conversation quality may vary, and you remain responsible for reviewing call results before acting on them.

8. Limitation of liability

To the maximum extent permitted by law, Voxpect AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Termination

Either party may terminate the relationship at any time with written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases and we will handle your data as described in our Privacy Policy.

10. Changes to terms

We may update these Terms from time to time. We will notify active customers of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal proceedings.
